CHARTER TERMS AND CONDITIONS
OUTLINE
This Equipment Use and Hire Agreement sets out the details for equipment and resources to be hired or used from the Russell Coutts Sailing Foundation.
AGREEMENT
The Charterer agrees to be responsible for all the RCSF equipment chartered via this website
The Charterer will be fully responsible to cover all costs of repair or replacement for equipment damaged or lost, subject to the discretion of the RCSF or their authorised agents or employees.
If damage or loss is as a result of negligence or intentional mistreatment, then the Charterer acknowledges that he/she will liable for full the replacement cost of teh damaged equipment
The Charterer acknowledges and understands there are inherent risks involved in sailing and hereby confirms that the intended skipper and crew (where appropriate) has the relevant experience for the safe operation of the hired equipment.
The Charterer shall not hold the RCSF liable for any injury sustained in connection with the use of the equipment.
The Charterer agrees to treat the equipment rented with care and wash down the equipment after every use.
The Charterer agrees to return all the equipment to RCSF at conclusion of the Charter Period in a clean and tidy condition.

Users Sailors, parents, participants of the RCSF or from time to time other persons or groups as permitted by the RCSF
Equipment
Any assets owned by or under the responsibility of the Russell Coutts Sailing Foundation, it’s Trustees or Employees, that is hired
RCSF
The Russell Coutts Sailing Foundation, trustees and employees
Users Sailors, parents, participants of the RCSF or from time to time other persons or groups as permitted by the RCSF

OBLIGATIONS
The RCSF will provide equipment for hire or use at their discretion, and take all reasonable measures to provide these items in safe, working condition.
The RCSF shall make all reasonable repairs and provide assistance where required and/or reasonably possible to do so.
Users shall take all necessary and practical steps to keep all equipment hired from the RCSF in the same condition at which it was hired out in and avoid or limit any and all loss or damage in all circumstances.
A damage deposit of $250 shall be taken from the user and held until the end of the hire period.
Users shall disclose any and all damage or loss to the RCSF. It is at the discretion of the RCSF as to whether a damage deposit is used in full or in part to cover these incidences.
The equipment hired as per this agreement shall be used solely by the user specified or as otherwise agreed or permitted by the RCSF and its coaches.
